What is a Prenuptial Agreement?

A prenuptial agreement is a contract entered into before marriage that modifies the property rights of the spouses. Prior to a couple getting married they can choose to make a contract to resolve issues of property division and support if the marriage ends in death or divorce.

A prenuptial agreement is designed to protect a spouses’ future, especially today, when statistics show that one in three marriages ends in divorce. A prenuptial agreement can also be a wise financial plan. If both parties can be honest and view this as a business agreement, then the emotional feelings involved in having an agreement before marriage, may actually strengthen a relationship. It should be emphasized that it is in both parties best interest that there be no secrets about assets before the wedding.
